The following are the terms of use (“Terms”) that govern your use of the Benchwarmer Sports website (the “Site”) and inherent mutual party obligations.
Terms and Schedule of Payments

All published package prices are quoted as per Person rates.

A deposit is required to secure a reservation. Reservations are accepted on a first-come, first-served, basis, and no space will be held without payment. All quotes are subject to availability and price fluctuation until the required deposit is received and processed.

Payment in full is due 60 days prior to the event. Subject to the Cancellation and Refund Section below, failure to pay in full 60 days prior will result in forfeiture of space.

Forms of accepted payment include business or bank check, paypal, wire transfer, MasterCard, Visa, Discover and American Express. Under some circumstances, proof of identity and a signed credit card authorization form may be required.
Cancellation and Refunds

The initial required deposit is non-refundable.

All reservations canceled 60 or more days before the event are eligible for a refund less the initial deposit; cancellations less than 60 days from the event are totally non-refundable.

All cancellations and requests for refunds must be in writing.

If an event is canceled or postponed, Benchwarmer Sports will not be responsible for any costs or expenses (including accommodations, travel, meals, etc.) beyond the scheduled package date of the applicable event. Refunds will only be made to the extent that refunds are actually issued to Benchwarmer Sports.

Masters practice and tournament event badges/tickets must be used only on the contracted date(s) of service. Buyer assumes all risk and no refunds apply for event cancellation or postponement due to weather conditions. An additional refundable deposit is required to ensure the safe and timely return of all badges.

Except as expressly set forth herein, no refunds or credits will be given for any reason including, but not limited to, any of the following: illness; changes in travel dates or plans; travel documentation requirements; reduction in group size; unused tours; unused portion of tours; and reservations canceled due to failure of purchaser to comply with the terms and conditions listed herein or applicable law.

Benchwarmer Sports reserves the right to reject reservations which were falsely generated through Site malfunction. This does not limit Benchwarmer Sports the right to cancel a reservation, at its sole option, for any other reason. If Benchwarmer Sports cancels reservations without cause attributable to purchaser or force majeure, a full refund will be remitted to the canceled party, and such refund shall be the sole and exclusive remedy of purchaser in the event of cancellation by Benchwarmer Sports.
Tickets to Events

Benchwarmer Sports will only guarantee adjacent seats for two (2) people. Benchwarmer Sports will attempt to honor requests for odd numbers of adjacent tickets but is unable to offer any guarantees due to limited release of tickets in odd quantities.

Benchwarmer Sports is not responsible for the theft, loss, delay, destruction, or misplacement of any tickets delivered electronically, by mail, express delivery, or left at will call. When tickets are hand delivered or picked up on-site in the event city, valid proof of identity will be required or tickets will not be tendered.

Event tickets will be delivered no later than 3 hours prior to the event.

Tickets only, ticket upgrades and extra hotel nights, if available, will be charged at NET RATES.

Seat locations are guaranteed to be within the specific sections or categories selected or better. Benchwarmer Sports reserves the right to provide upgraded ticket locations at no additional cost to purchaser.
Hotel Policies

No Shows and Cancellations are subject to a 100% charge.

Your room will be guaranteed for late arrival. No refunds for unused nights, including those resulting from delayed check-in or early check-out, will be given.

Except for the hotel room rate and associated room taxes, the package DOES NOT include payment for mandatory hotel service fees, resort fees or optional charges you make for on-site incidentals. You will be required to present a credit card upon check-in to pay the hotel directly for any mandatory hotel fees and optional incidental charges. Examples: Parking, Minibar Snacks, Phone Calls, Room Service.

You will be required to present a valid credit card or cash deposit at check in for incidentals.

Bed types and smoking preference will be requested but are subject to hotel availability and are not guaranteed.

You must present photo ID at check-in. Guests must be at least 18 to 21 years of age at time of check-in (depending on individual hotel policy) unless accompanied by a parent or guardian.
Hotel amenities are subject to change as provided by the individual hotel.
Conditions and Requirements

Wharf Travel Services, Inc. is a fully accredited Travel Agency and the parent company of Benchwarmer Sports. Hotel reservations and group blocks may reflect Wharf Travel Services, Inc. as the booking agent.

Benchwarmer Sports reserves the right to substitute hotels of equal status and alter itinerary for any reason and without notice.

Published prices reflect the total package cost at the time of booking. Once the require payment has been received and processed, your package price is guaranteed to not change. If future published prices are increased, no any additional charges will be assessed. Correspondingly, if there is a reduction in published prices, no discount or refund is applicable.

Passenger Names must be received no later than 14 days prior to the start of the package. Any name changes made within 14 days prior to start of the package will be assessed an administrative fee of $100.00 per change.

It is the responsibility of individual travelers to obtain the documentation required for their trip such as passports, visas, birth certificates and photo identification. Travelers entering the United States and Canada are required to show proof of citizenship for entry. Those denied at any border will not be entitled to a refund.

By purchasing this package, attendees agree to abide by all rules of the events and to conduct themselves in an orderly manner. Failure to do so may lead to expulsion from the event. Eash attendee must be 21 or older to consume alcoholic beverages.
COVID-19 and Infectious Diseases

WARNING: The novel coronavirus SARS-CoV-2 and any resulting disease (together with any mutation, adaptation or variation thereof, “COVID-19”) is extremely contagious and there is an inherent risk of exposure in any place where people gather, regardless of precautions that may be taken. COVID-19 is an extremely contagious disease that can lead to severe illness and death.

COVID-19 Policy: All attendees may be subject to restrictions and requirements put in place by venues, teams, or government authorities as it pertains to social distancing, wearing personal protective equipment, temperature checks, proof of Negative COVID test, proof of Covid-19 vaccine and/or similar measures for event entry.

By partaking in this package and related travel, each traveler voluntarily assumes all risks associated with COVID-19 and other infectious and/or communicable diseases, viruses, bacteria or illnesses. We advise all guests to take necessary precautions and to obtain appropriate insurance coverage.
Limitations of Liability
Purchaser acknowledges that Wharf Travel Services, Inc. dba Benchwarmer Sports (the “Company”) is acting as an independent intermediary for suppliers of goods and services, such as hotel accommodations, transportation, meals, tours, event tickets and cruises, that the Company does not supply, endorse or warrant these goods and services. The Company shall not be liable for any acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers, or for any personal injuries, death, property damages, or any other damages, losses, expenses or delays to you or your travel companions or group members resulting there from. The Company shall have no liability and shall make no refund for any injuries, damages, losses, expenses or delays caused to you or any traveler in connection with terrorist activities, war, insurrection, social or labor unrest, mechanical or construction difficulties, diseases, local laws, weather or climatic conditions, re-routing, overbooking, strike, abnormal conditions or developments or any other acts, errors, or omissions or conditions outside the Company’s direct control.
Each traveler voluntarily assumes all risks, and is advised to obtain appropriate travel insurance coverage. Traveler’s use of services, retention of tickets, vouchers, or booking after issuance shall constitute his/her consent. Additionally the purchaser acknowledges and agrees that he/she/it will cause all travelers in his/her/its party to be bound by all the terms and conditions hereof. Purchaser hereby acknowledges and accepts all of these terms and conditions and agrees to indemnify and hold the Company harmless in making the arrangements on purchaser’s behalf, and agrees that refunds, restitution or damages, if any are claimed, shall be sought directly from the suppliers and not from Company. In no event shall the Company or its suppliers be liable for any indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with, the goods and obtained through the Company or its suppliers; or otherwise arising out of these terms and conditions, whether based on a theory of negligence, contract, tort, strict liability, or otherwise, and even if the Company or its suppliers have been advised of the possibility of such damages. If, despite the limitation above, the Company or its suppliers are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then the liability of the Company and/or its suppliers will in no event exceed, in the aggregate, the greater of (a) the total paid to the Company or (b) One-Hundred Dollars (US$100.00) or the equivalent in local currency.
Our Privacy Policy and any other policies, rules or guidelines that may be applicable to particular offers on the Site are also incorporated into these Terms. These Terms shall constitute a valid, binding and enforceable legal agreement among you and Benchwarmer Sports. There shall be no other oral or implied agreement between you and us that shall be binding or enforceable. By visiting or using the Site, you expressly agree to these Terms, as may be updated at any time. Any changes we make will be effective immediately when we post a revised version of these Terms on the Site. The enclosed “Last Updated” date will inform you of when these Terms were last revised. By continuing to use this Site after that date, you agree to the changes.
